Hong Kong Court of Final Appeal upholds constitutionality of face mask ban

Rejecting a legal challenge by more than 20 opposition figures in the city, the Hong Kong Court of Final Appeal on December 21, upheld the constitutionality of the face mask ban that, last year amid the turmoil was imposed by Hong Kong Special Administrative Region (HKSAR) Chief Executive Carrie Lam.

October 2019, the HKSAR government invoked the power under the Emergency Regulations Ordinance (ERO) that has been ruled constitutional by the court and passed the Prohibition on Face Covering Regulation, commonly known as anti-mask regulation.

 The five judge bench also ruled that the ban on face masks at unauthorized protests and rallies in the city was proportionate and no more than reasonably necessary to prevent violence.
